Taco Bell Sued Over Meat That's Just 35 Percent Beef

Taco Bell might want to change it's "Think Outside the Bun" campaign to "What's Really in That Taco?" after a class-action lawsuit filed against the fast-food giant claimed its taco filler doesn't, um, "meat" federal standards.

The suit against the YUM-brands chain also has a "beef" with the company's advertising, charging its claims of using "seasoned ground beef" or "seasoned beef" in its food products is false.

According to the suit filed by the Alabama law firm Beasley, Allen, Crow, Methvin, Portis & Miles, the YUM-brands owned chain is using a meat mixture that contains binders and extenders, and does not meet the minimum requirements set by the U.S. Department of Agriculture to be labeled as "beef.”

Attorney Dee Miles said the meat mixture contained just 35 percent beef, with the remaining 65 percent containing water, wheat oats, soy lecithin, maltodrextrin, anti-dusting agent and modified corn starch.

The suit was filed on behalf of Taco Bell customer and California resident Amanda Obney, who is not seeking monetary damages, but instead wants a court to order Taco Bell to be honest in its advertising.

"We are asking that they stop saying that they are selling beef," Miles said.

Irvine, Calif.-based Taco Bell spokesman Rob Poetsch said the company denies that its advertising is misleading and said the company would "vigorously defend the suit."

While the company does list its ingredients on its website — and indicates whether they are allergens — registered dietitian and Fox News contributor Tanya Zuckerbrot said the fillers could be a danger for some consumers.

“Wheat oats, soy lecithin and maltodrextrin are common allergens that are often added to processed foods as fillers because they are much less expensive than meat,” she said. “Aside from being misleading, this form of false advertising puts the consumer at risk as well.”

Zuckerbrot said according to the USDA, “ground beef can have seasonings, but no water, phosphates, extenders, or binders added.” The meat from Taco Bell does not meet the minimum requirements set by the USDA, she said.

“Rather than Taco Bell calling the meat ‘seasoned ground beef’ they should refer to it as ‘mixed meat’ and list the additional ingredients so consumers can know what they are putting into their mouths,” she said.

Stafon Johnson Files Lawsuit Against USC Over Weightlifting Accident

Former USC running back Stafon Johnson has filed a lawsuit against USC over a weightlifting accident that almost killed him -- claiming his USC weightlifting coach recklessly struck the bench press bar that crushed his neck. Johnson claims he was bench pressing 275 pounds in the USC weight room in Sept. 2009 -- part of the required football regimen -- when Jamie Yanchar, an assistant strength and conditioning coach for the football team, was "spotting" him.

While Johnson attempted to grasp the bar on his own, Yanchar allegedly struck the bar, knocking it off balance and slipping from Johnson's hands. The bar fell on to his neck causing severe injury and ending his college football career.

According to the suit, filed today in L.A. County Superior Court, Yanchar's "negligent, careless and reckless" action in striking the bar "substantially increased the risk inherent in Mr. Johnson's bench pressing."

Johnson -- who eventually signed with an NFL team -- is suing for unspecified damages including loss of future earnings.

UPDATE: A rep from USC released a statementt saying, "USC firmly believes it was not at fault in Stafon Johnson's unfortunate weightlifting accident. We are sorry that Stafon was injured."

The statement continues, "USC and the entire Trojan Family have been exceptionally supportive of Stafon from the minute the accident occurred. We are disappointed to learn that Stafon has decided to file a lawsuit against USC."

Packers Vs. Bears: Caleb Hanie Takes Over For Todd Collins; Jay Cutler Out

Chicago Bears QB Caleb Hanie, whom none of us have ever heard of, has taken over for QB Todd Collins behind center. FOX’s Chris Myers mentions Hanie’s mobility as being highly preferable to Collins’, so there’s that. But who in the world is Caleb Hanie?

Jay Cutler is apparently out of the game due to his knee injury, leading many to question his heart and toughness and patriotism and so forth. At one point Brian Urlacher was seen speaking to Cutler, who just kept moping around the sideline with his coat on. Since Hanie was inserted before the fourth quarter began, he's the only quarterback allowed to play for Chicago from this point on.

Hanie has played in five games, completing eight regular season passes, in his three seasons since leaving Colorado State. Caleb Hanie? He went undrafted in 2008, and apparently has been a fan favorite among certain Bears fan circles.

The Bears have actually gotten the ball moving on Hanie’s first drive, so maybe somebody was on to something.

Regis Philbin quit his show because production executives told his agent, Jim Griffin, that they would be cutting his current 18-20 million dollar salary when his contract expired. The executives were whining about Regis taking so much time off the show and the show not doing as well as expected. Well Regis showed them his perspective when he announced – totally without warning – on air that he was retiring from the show.

Regis told Kelly Ripa about his decision 15 minutes before they went on the air. Initially we were heard that she was stunned but not angry but now its come out through sources close to the show that she was absolutely furious. A source says, “She felt it showed a total lack of respect for her.”

Apparently the entire production team is angry at Regis because they feel he hurt the show by blindsiding everyone.

As for Regis’ agent, Jim Griffin, he has been fired. Regis feels Griffin did not negotiate the upcoming deal effectively.

That’s life in the big city and on the mean streets of professional entertainment – what have you done for me lately?

Valdosta WR/CB Malcolm Mitchell, a Rivals four-star, verbally committed to the Georgia Bulldogs over the Alabama Crimson Tide at a crowded hibachi restaurant in his hometown Thursday night as his mother looked on in a Florida Gators hat (?). Mitchell eventually placed the hat on the table next to Georgia and Alabama hats, delaying the announcement for over 40 minutes and actually personally calling for a commercial break at one point. Congrats, Dawgs, you’re getting a drama queen.

Jay Rome was also in attendance — both he and Mitchell were decked out in red and black.

The announcement was also supposed to broadcast live on talk921.com, but seriously, you guys just invited every Bama fan at once onto your website and you’re surprised it crashed? ROLE TAAAAHD.

Mitchell, like Rome before him, narrowed his list down to the Dawgs and Tide, but this one was actually a battle. While Rome had been thought of as in the bag for Georgia for weeks, the race for Mitchell came down to the wire, with coaches from both teams paying him visits up until today.

The six-foot-one, 187-pound speedster also received offers from four other SEC schools plus the Clemson Tigers. He’s ranked by Rivals as the nation’s top cornerback and the No. 15 player from the state of Georgia. Quick and lengthy with 4.4 speed, he’s been talked about as a potential return man.

Kennedy Center take over Washington National Opera

Kennedy Center to take over Washington National Opera


It's official. In a move that had been discussed for months and openly rumored as long ago as last summer, the Kennedy Center announced Thursday that it is officially taking over the Washington National Opera.

The "affiliation," as the agreement was termed in a Kennedy Center press release, was unanimously approved by the Kennedy Center's board at a meeting Wednesday. It will take effect July 1.

"Over the past few years," WNO president Kenneth R. Feinberg said Wednesday, "the financial uncertainty surrounding the opera has threatened not only its viability but its ability to … maintain a level of artistic excellence. This is a critical step designed to assure the long-term artistic and financial success of the company."

Translation: Without this merger, the Washington National Opera, financially strapped, without strong leadership, reduced to a mere five operas a year, was doomed.

The affiliation means that WNO is following in the footsteps of the National Symphony Orchestra, which became an affiliate of the Kennedy Center in 1986. It is notable that neither of the leading classical music organizations in the nation's capital has been able to maintain its complete financial and administrative independence without being taken into the Kennedy Center fold.

The opera and the Kennedy Center have discussed a possible merger for at least a year, conditional - from the Kennedy Center's side - on WNO's ability to pay off its debts and arrive unencumbered. One obstacle, as reported last summer, was the resistance of one of the opera's principal benefactors, Betty Brown Casey, who had stated that if WNO ever merged with the Kennedy Center, she would withdraw her donations, including the company's $30 million endowment, and give the money to the Metropolitan Opera, instead.

Casey recently came to the realization that there was no other option if opera in Washington was to survive, according to someone familiar with the negotiation who spoke on condition of anonymity. Indeed, Casey offered a matching donation to enable the company to pay off its debt and come to the Kennedy Center with its endowment - an impressive dowry - intact.

The affiliation will mean considerable changes for WNO. While the company will retain its board, some key staffers and its identity, the Kennedy Center will take over the opera's administrative and business functions, which will entail considerable streamlining and inevitably a number of job cuts. "Staffing remains to be worked out completely," said Feinberg, who also is the TARP "Pay Czar" and is overseeing restitution for the gulf oil spill.

WNO's artistic leadership, including the new music director of the Kennedy Center Opera House Orchestra, Philippe Auguin, will now work together with Michael Kaiser, the president of the Kennedy Center. Kaiser comes from an opera background: His first role in the arts was as a board member of the then-Washington Opera (the "National" came in in 2004) from 1983 to 1985. He later ran the Royal Opera House at Covent Garden in London for "two years, one month, and nine days," he said.

Kaiser fully intends to hire an artistic leader to replace the outgoing general director, Plácido Domingo, who announced in September that he would not renew his contract when it expires at the end of the current season.

But Kaiser has his own vision for changes at the opera. While next season is already set - WNO will announce it Feb. 1 - he hopes that there will be some new elements in place by 2012-13. In addition to presenting opera in the opera house, he envisions using some of the Kennedy Center's other performance spaces for smaller or newer operas that may not easily sell as many tickets. And he would like to expand the Kennedy Center's curatorial role by presenting the work of some other companies.

"I would like to bring in some really good avant-garde opera from abroad," Kaiser said. "There's some really good … work being done that we are not currently seeing in this country."

Gov.elect Robert Bentley intends to be governor over all, but says only Christians are his 'brothers and sisters'

MONTGOMERY -- Gov.-elect Robert Bentley in a speech at a Baptist church this afternoon said he plans to be the governor of all Alabamians and be color-blind, but he also said people who aren't ''saved" Christians aren't his brothers and sisters.

Bentley told a big crowd at Dexter Avenue King Memorial Baptist Church, where the late civil rights leader Rev. Martin Luther King Jr. once was pastor, that he believed it was important for Alabamians ''that we love and care for each other."

''I was elected as a Republican candidate. But once I became governor ... I became the governor of all the people. I intend to live up to that. I am color blind," Bentley said in a short speech given about an hour after he took the oath of office as governor.

Then Bentley, who for years has been a deacon at First Baptist Church in Tuscaloosa, gave what sounded like an altar call.

"There may be some people here today who do not have living within them the Holy Spirit," Bentley said. ''But if you have been adopted in God's family like I have, and like you have if you're a Christian and if you're saved, and the Holy Spirit lives within you just like the Holy Spirit lives within me, then you know what that makes? It makes you and me brothers. And it makes you and me brother and sister."

Bentley added, ''Now I will have to say that, if we don't have the same daddy, we're not brothers and sisters. So anybody here today who has not accepted Jesus Christ as their savior, I'm telling you, you're not my brother and you're not my sister, and I want to be your brother."

Asked later if he meant to be insulting to people of other faiths, Bentley replied, ''We're not trying to insult anybody."

Bentley's communications director, Rebekah Caldwell Mason, when asked about Bentley's comments said, ''He is the governor of all the people, Christians, non-Christians alike."

Bentley in his speech also told the crowd, which was celebrating King's birthday, that, ''I think that Dr. Martin Luther King was one of the greatest men that has ever lived."

''I appreciate what he has done for not only the African-American community but for the white community, because he helped everything to change, even though he had to give his life for it," Bentley said.

Bentley then said he would work to help Alabamians whether they live in Wilcox County, where many poor blacks live, or Mountain Brook, where many upper-income whites live.

''You know, (for) a lot of people, it's hard to trust a Republican governor," Bentley said. ''Let me tell you. I want to tell you today that I promise you that I'm going to do everything I can for everybody in this state."

Mike Florio Embarrasses Aaron Rodgers

Mike Florio Embarrasses Himself Moralizing Over Aaron Rodgers And Jan Cavanaugh And Non-Story

As we discussed yesterday, NBC Sports personality (and noted Minnesota Vikings fan) Mike Florio went after Green Bay Packers quarterback and Cal football great Aaron Rodgers in his own little morality play on his soapbox at Pro Football Talk. It was tantamount to character assassination, since Florio decided to splice a second of tape of Rodgers not signing autographs, not fact-check with any sources that would have told him Rodgers had already signed something for the "snubbed Packer fan", and went off on a thousand word rant that basically ended with this sentiment: Aaron Rodgers is an a-hole who hates cancer patients, despite plenty of evidence to the contrary. You stay classy Florio.

Florio looks even more foolish after cancer patient Jan Cavanaugh (the "snubbed Packer fan") seemed shocked by all the controversy this non-story has drummed up.

"I am very unhappy with people making so much out of this, because this really isn't that big of a deal. It's up to the players to decide who they want to give an autograph to, and that's their prerogative."

Unfortunately, for whatever reason, DESPITE Cavanaugh publicly rebuking all this noise, Florio didn't recant from his stance, nor did he apologize for drumming up the controversy in the first place. No, he went on the offensive, like Custer running straight into the charging Sioux.

Star-divide

As to the idea that Jan Cavanaugh wasn’t bothered by Rodgers’ decision to snub her, that’s her prerogative. And we respect her for it. She’s a Packers fan, she lives in the area, she wants to see the team do well, and she’s got bigger things in her life to worry about than whether Aaron Rodgers will give her the time of day.

So now let me get this straight Florio. Because Cavanugh refuses to fit the ridiculous narrative you're been trying to promote, she too is subject to your scorn so you can keep the moral indignation going? It's nice that Mike Florio knows what Jan Cavanaugh wants more than Jan Cavanaugh.

Many Packers fans have pointed out all the charitable things that Rodgers has done over the years. He deserves credit for that. And so allow us publicly to declare, "Attaboy."

Folks who frequent this site on a regular basis know that we aren’t terribly impressed by the things athletes do while the world is watching.

Packers fans had to point out the charitable things Rodgers has done to Mike Florio. Clearly Mike Florio didn't know about it, and he's part of the world that watches Aaron Rodgers. So how exactly is the world watching the acts of good faith of Aaron Rodgers if only Packers Nation knew about it?

Mike, you'd be best off googling "Aaron Rodgers cancer" right now and see what type of negative image you've propagated on him with your hack rantings. Does that seem like a man that goes out of his way to promote himself as a valiant warrior in the fight for cancer? Sounds like a humble guy who wants to keep his profile low and in the background.

Rodgers not drawing attention to himself for his charitable actions reminds me of a fellow NFC North quarterback. I wonder what Mike Florio thinks of him.

As one high-level executive with a team other than the Packers (and not an NFC North rival) observed in response the WBAY video, what we do when tired, cranky, busy, etc. reveals more about our true character than what we do when attending a charitable event arranged through the team and/or handlers.

Excellent, Shadowy Leader X has proclaimed Rodgers's guilt in the vaguest way possible. Please lead me through the desert into the Promised Land, Shadowy Leader X. When you get tired and cranky when there's not enough water, I'll call you mean names too!

For some bloggers inclined either to pander to Packers fans or to settle old scores with (or possibly, to gain some traffic by sparking a public fight) ...

Alright, that was funny. The lack of self-awareness by Florio about sparking public fights on the Internet is unbelievably amusing.

Whoever walked by Jan Cavanaugh like she wasn’t even there was going to get reamed on the pages of PFT, because I believe that cancer patients deserve the highest level of respect and deference that can be provided.

Okay Florio. Since you seem to get off at punishing Rodgers for "hating cancer patients, show us that you can match Rodgers's contributions to fighting cancer, dollar-for-dollar. Put your wallet where your mouth is and show that you have the same amount of moral fortitude as the athlete you crusade against.

And if you can't come close to that, don't be surprised if people start saying you hate cancer patients too.

House kicks off debate over health-care repeal


The House meets Tuesday for its first day of debate on a measure that would repeal the national health care overhaul, following a week during which legislative action came to a standstill following the Tucson shooting tragedy.

Debate on the health care repeal bill is expected to begin after the House reconvenes at 2 p.m. The House has set aside seven hours for debate on Tuesday and Wednesday, with a vote on the measure expected to come Wednesday afternoon.

The repeal measure is expected to pass the House on Wednesday but is unlikely to make it through the Senate, where Democrats still hold the majority.

Worth watching will be just how much the tenor of the debate will have changed in the aftermath of the Tucson shootings. A new Washington Post-ABC News poll shows that 82 percent of Americans believe the tone of political discourse is negative, with 49 percent saying that it's negative enough to encourage violence.

Over the weekend, there were some signs that congressional leaders have begun adjusting their rhetoric. A post on House Speaker John Boehner's (R-Ohio) Web site described the health care law as "job-crushing" and "job-destroying" rather than "job-killing." Democrats, meanwhile, have begun to frame the repeal effort as a "Republican plan to repeal patients' rights."

In addition to Tuesday's floor debate, backers and opponents of repeal were also gearing up for a series of dueling Capitol Hill news conferences. House Minority Leader Nancy Pelosi (D-Calif.) announced that the House Democratic Steering and Policy Committee will hold a hearing Tuesday afternoon featuring testimony from seven ordinary Americans on how repeal of the health care law would affect them.

Iowa Republican Rep. Steve King, meanwhile, is planning a news conference at 3 p.m. at which he and other House Republicans are slated to receive hundreds of thousands of petitions demanding the repeal.

Also expect to see lawmakers speak out on the floor not only on the repeal itself but also the process by which the bill has been brought up; Democrats have argued that Republicans have minimized the minority party's role in the process by not holding any hearings on the bill and by limiting the number of amendments that may be proposed. Republicans have contended that the health care overhaul has already been litigated and that the public stands firmly in favor of repeal; they have also allowed for an amendment proposed by Rep. Jim Matheson (D-Utah) regarding the "doc fix," requiring the committees working on replacing aspects of the law to provide a permanent fix for the formula that sets Medicare payments for physicians.

Amber Van Brunt Nurse Fights for License

Amber Van Brunt Nurse loses license for 20 years over sex with hospice patient


A hospice nurse has been barred from her profession for 20 years after admitting to a sexual relationship with her married terminally ill patient.

The Oklahoma Nursing Board in August disciplined Amber Van Brunt, 33, of Shawnee, for unprofessional conduct. Now, she is asking an Oklahoma County judge to reverse the board’s order “to correct this miscarriage of justice.”

A hearing is set for Wednesday.

At the heart of the appeal is an ethical question: Is it ever right for a nurse to have sex with a patient?

Van Brunt’s attorney told the judge the consensual relationship with the patient was on the nurse’s “own personal time,” while she was visiting as a friend, not while she was on duty caring for him.

The nursing board responded that there is evidence of sexual contact during nursing visits but that it doesn’t matter when it happened.

“The nurse is the professional in this situation. It is the responsibility of the professional to say no to the vulnerable patient,” the board’s attorney told the judge. “The rules … do not mean simply while you are on shift; they mean during the entire time ... you are assigned to the care of that patient, whether that is six days in the hospital or six months in hospice care or six years in a nursing home.”

The patient, Chris Reiter, 43, suffered from Lou Gehrig’s disease. He said he was seduced. Van Brunt worked for Angelic Family Hospice in Shawnee.

She began caring for the former Hershey Foods salesman in November 2009 at his Shawnee home. He had been told months earlier he had six months or less to live.

His wife, Liz Reiter, 41, told the board she suspected her wheelchair-bound husband was having an affair with the nurse, but he denied it in February.

She said in March she discovered on his computer graphic messages between her husband and the nurse after he tried to commit suicide.

She told the board she felt “horrible, betrayed.”

She testified, “After all of the things that I had been doing to take care of him and that this is what happened.”

Attempted suicide
Chris Reiter made the suicide attempt March 4, two days after Van Brunt told him in a text message that she was pregnant by another man, according to evidence given to the nursing board. Van Brunt was visiting him at the time of the attempt. She called 911 after he took several muscle relaxants.

He told a hospice social worker March 5, “What a fool I have been. I have messed up everything,” according to the evidence.

He never returned home. He died May 21 in Illinois.

Liz Reiter indicated to the nursing board that he starved himself to death.

They married in 1996 and had two children. She moved to Nebraska after his death.

Van Brunt admits to “the mistake” of having a sexual relationship with a patient, her attorney, Kimberly Stevens, told District Judge Patricia Parrish. The attorney said Van Brunt was a young, inexperienced nurse working in an emotionally demanding field of practice and “fell in love.”

The Oklahoman twice asked for an interview with Van Brunt, but her attorney never made her available.

Who made complaint?
Van Brunt got her nursing license in October 2008. She can apply for reinstatement of her revoked license in August 2030 if she pays a $5,000 penalty. The board did not reveal who made the complaint against her.

She was not accused of any crime because of the relationship.

Van Brunt did visit the patient several times while off duty, drinking with him and watching football on TV, according to testimony before the board. Liz Reiter said she even asked the nurse to stay overnight with her husband twice last January while she underwent a sleep study.

Chris Reiter on March 9 signed a typed statement that “Amber Van Brunt had inappropriate contact with me multiple times during regular hours nursing visits.” Weeks before his death, he and his wife filed a negligence lawsuit against Angelic Family Hospice. The lawsuit was later dropped.

In their written exchanges last February, Van Brunt called her patient “sexy” and “lover.”

The last exchange came in March after she wrote she was “knocked up.”

He wrote, “You broke my heart babe.”

She responded at one point, “I wish it was u.”

Sylvain Distin admits sadness over Steven Pienaar's likely Everton exit

The Everton defender Sylvain Distin is saddened by the apparent imminent departure of Steven Pienaar and frustrated by constant speculation linking others with the Goodison Park exit.

Pienaar, who is out of contract at the end of the season, looks set to leave during the current transfer window after the club accepted an offer from Chelsea. The South Africa international has been one of Everton's driving forces over the past two seasons and Distin does not want him to go, particularly at a time when the manager, David Moyes, would like to recruit.

"It's disappointing to lose Steven," Distin said. "You don't want to lose one of your best players but that's football. Everywhere I've been it's been the same, there's not much we can do – just stay focused and carry on doing what we're doing. I don't think it's a done deal yet but it's disappointing."

Tottenham, one of the other clubs to have shown interest in signing Pienaar, have also been linked with a move for Phil Neville, although that was rubbished by Moyes. Distin added: "It's not a good feeling when you hope for reinforcements and instead it's just talk about your best players going. All we can do is wait and see what happens in the transfer window but I would rather keep those two players that's for sure."

Moyes's hopes of bringing in more players may actually depend on whether he can raise any money through sales. The Scot was only able to bring in three players on free transfers last summer and he has said he will have to concentrate on the loan market this January.

An undisclosed loan fee has been received from Leicester for Ayegbeni Yakubu and Pienaar's departure, if it can be concluded quickly, may give Moyes some leverage to bring in another striker. But Distin believes it is getting tougher to compete with other clubs for new signings.

The 33-year-old said: "It's obvious that the league is getting tougher and every team can get big players. Teams like Sunderland and Birmingham are buying players that three years ago they'd never have dreamed of signing. It's not a secret that we would like to have more players but there's nothing we can do about it. We have to stay focused and we've got enough quality already to play good games."

Distin was on the scoresheet in yesterday's entertaining 2-2 draw at Liverpool in the Merseyside derby. Both sides will take encouragement from their performances but will not be happy to be just four points above the relegation zone.

"Four points against Liverpool is okay but everyone is quite disappointed because we felt like we could've won that game," Distin said. "But in the cold light of day, three points at home and one away is good overall.

"We could have easily been two or three nil down at half-time so overall it was a fair result. It could end up a race with Liverpool to get up the table now but we're having a positive month with some good results and if we carry on we can end up towards the right end of the table."

Amid speculation over what Jobs' absence will mean for the Cupertino company, now the most valuable tech firm in the world in terms of market capitalization, some have noted that Cook already plays a major role, albeit a less public one, in overseeing Apple. Bloomberg wrote in 2009, during Steve Jobs' last medical leave of absence, that insiders say Cook has already "been quietly running the company for several years."

"Tim runs Apple and he has been running Apple for a long time now," Michael Janes, a former Apple executive, told Wired in 2009. "Steve is the face of the company and very involved with product development but Tim is the guy who takes all those designs and turns it into a big pile of cash for the company."

Swiss Whistleblower Rudolf Elmer To Hand Over Offshore Banking Secrets To WikiLeaks

LONDON — A former Swiss banker on Monday supplied documents to WikiLeaks that he alleges detail attempts by wealthy business leaders and lawmakers to evade tax payments.
Rudolf Elmer, an ex-employee of Swiss-based Bank Julius Baer, said there were 2,000 account holders named in the documents, but refused to give details of the companies or individuals involved.
He has previously offered files to WikiLeaks on financial activities in the Cayman Islands and faces a court hearing in Zurich on Wednesday to answer charges of coercion and violating Switzerland's strict banking secrecy laws.
"I do think as a banker I have the right to stand up if something is wrong," said Elmer, who addressed reporters at London's Frontline Club alongside WikiLeaks founder Julian Assange.
"I am against the system. I know how the system works and I know the day-to-day business. From that point of view, I wanted to let society know what I know. It is damaging our society," Elmer said.
Assange praised the ex-banker's attempts to expose alleged shady practices in the financial industry. He was making a rare public appearance since he was released on bail on Dec. 16 following his arrest on a Swedish extradition warrant.
Elmer claims his previous disclosures showed evidence of major tax avoidance in the Caribbean.
However, Assange said that with WikiLeaks focussed on other issues – such as the publication of its cache of about 250,000 diplomatic cables, it could be several weeks before Elmer's latest files are reviewed and posted on the organization's website.
The organization has so far posted about 2,444 cables to the Internet since it began publishing the documents in November.

Assange said that, as with other WikiLeaks releases, media organizations – he named the Financial Times and Bloomberg as possible candidates – could be given the information ahead of time.
He said that the files, or parts of the files, may also be provided to British government fraud investigators to examine for any evidence of criminal wrongdoing.
"We will treat this information like all other information we get," Assange said. "There will be a full revelation."
The Julius Baer bank said it was aware of Elmer's decision to pass a new set of files to WikiLeaks.
"He didn't attack us at this press conference, he explicitly targeted not us but 'the system,'" the bank's spokesman Jan Vonder Muehll said.
Britain's tax authority declined to comment when asked about Assange's plan to supply details of alleged wrongdoing.
Under the terms of his release on bail, Assange must live at the mansion home of Vaughan Smith, the owner of the Frontline Club. He has compared the regime to "high-tech house arrest," but has recently promised that the flow of leaked documents published by his organization would increase.

Gregg Allman: The Road DOES Go On Forever

(CBS) "Melissa" was a big hit for the Allman Brothers Band back in 1972. These days, Gregg Allman is still performing, and still on tour. Chip Reid offers this Sunday Profile:


By now, the songs are like old friends.

After 42 years, more than 30 albums, and thousands of concerts, Gregg Allman never gets tired of singing them.

Reid asked Allman why he loves singing so much.

"It's like going to an analyst and just spilling your guts," he said. "You know, something that's been bugging you for a long time and you finally tell this person, 'Look, here's the way it is.'"

There’s no question the Allman Brothers - the bluesy, jam-band pioneers who all but invented Southern Rock - have earned a special place in rock history...

Now they have their own museum to prove it.

They call it "The Big House" - the ramshackle home in Macon, Ga., that the band shared for two magical years, from1970-72.

At the ribbon-cutting opening of the house full of memories, Gregg Allman said, "It looks a lot different than it did when I lived here."

"What did it look like then?" Reid asked.

"It looked like a bunch of hippies lived here, right?"

While Macon was the turning point, the band's journey began in Nashville, Tenn.

Gregory Lenoir Allman was born on Dec. 8, 1947, a year and 18 days after his brother Duane.

Tragedy struck early: Their father was murdered by a hitchhiker when Gregg was just 2. Big brother Duane had to fill the void.

"He knew just that much more than me," Gregg said, "and if we’d lived to be 95 and 96, I’d still be 'little brother.'"

But it was Gregg who first discovered music, when as a 9-year-old he saw a neighbor with a guitar.

"I said, 'What you got here, Jimmy?' He said, 'Well, it's a guitar, boy!'" Gregg laughed. "And he played 'She'll Be Coming 'Round the Mountain.'"

"So did you fall in love with the guitar the first time you saw it sitting there?" Reid asked.

"Yeah, I did. I did. It was like sparks flying, it was," he said.

Gregg taught Duane, who quickly became a virtuoso. They played together until 1969 when Duane assembled what would become the Allman Brothers Band. Gregg was reluctant to sign on - having already been accepted into college to be a dental surgeon.

"My brother said, 'We gotta go out here and tear up the roads a while,' you know?" Gregg laughed. "I said, 'I'll tell you what, I'll go out there for two years. And I'm going on back to med school.' Well, I got out there, the two years I was so far in debt, man, I had to stay."

In debt, perhaps, but along the way Gregg found he had a gift for song-writing, such as "Melissa," written in 1967 with Steve Alaimo.

Crossroads seem to come and go, yeah.
The gypsy flies from coast to coast
Knowing many, loving none
Bearing sorrow, havin' fun
But back home he'll always run . . . to sweet Melissa.

Was there a Melissa, Allman was asked.

"No," he told Reid. "It was a person that I had dreamed up, and I had everything in the song written but the title. And I got, 'But back home I’ll always run with sweet Barbara . . .' 'With sweet Mary Jo. . . '

Allman laughed, "I was flabbergasted, you know?"

Inspiration came to him in, of all places, a grocery store.

"I was the only one in the store, except for this one Spanish lady and she had this little toddler with her," Allman said. "She was everywhere. And one time, she just took off down this one aisle, and the lady just freaked out. And she went, 'Oh, Melissa, Melissa come back!'"

"And I went, 'Oh! (snap) Lady, I could kiss 'ya," he laughed. "'Mlissa,' that's it!"

The band released 2 albums, gaining little attention until 1971, when they recorded a performance at New York’s legendary Fillmore East.

The album "At Fillmore East" (featuring "Whipping Post") was a sensation. To this day it is considered one of the greatest live albums of all times.

Their wildest dreams had come true. But just 3 months later, it all came crashing down..

On Oct. 29, 1971, Duane Allman was riding his motorcycle down Hillcrest Avenue in Macon, when a truck turned in front of him.

"He had two speeds, man - hundred, and parked," Gregg laughed.

Gregg will never forget the phone call: "I hung up the phone and I just ran down the hill to the hospital. And there's a guy there meeting me. And he takes me into the chapel. And I knew it right then: Oh no," he said.

Duane Allman was dead at 24. Thirty years later, Rolling Stone magazine ranked him as the second greatest guitarist of all time.

The band carried on, with guitarist Dickey Betts shouldering more of the load.

But with his long blond hair and gritty, soulful voice, Gregg got most of the attention.

Sat down, wrote you a long letter,
Lord it seems just like the other day,
Said sure as the sunrise, baby,
Tomorrow I'll be up and on my way.
But I'll live on and try and be strong
'Cause it just ain't my cross to bear
("It's Not My Cross to Bear")

More than he bargained for, after his high-profile marriage in 1975 to Cher.

"I remember going to the grocery store and just seeing my face everywhere," Gregg recalled. "And I'm like, 'What is happening, you know?' She said, 'I told you this would happen!' Yeah, she warned me."

They were married for four years.

"There's still a friendship and a mutual respect there?" Reid asked.

"Yeah. I mean, we have a kid together and, you know, she's just - she's good people anyway.

There were a number of successful solo albums. And after breaking up, the Allman Brothers Band reformed in 1989.

These are good times for Gregg Allman, who said he loves living in the South. "It’s peaceful, it’s real quiet," he said. "If you’re born here, you never want to leave it."

Last year he underwent a successful liver transplant, and this week he’s releasing his first solo album in 14 years, "Low Country Blues."

At age 63 he’s back on tour.

It seems the man who first sang "The Road Goes On Forever" more than four decades ago wasn’t too far off.

"So, you're going to do it until you just can't do it anymore?" Reid asked.

"Oh, yeah!" Gregg chuckled. "Till they have to take my ass out there on a stretcher!"

Gregg Allman has lived the blues many times over

NEW YORK — Gregg Allman has earned the torment in his singing voice to a degree that's ridiculous even for a bluesman. Tragic deaths of family members and bandmates, drug and alcohol addiction and much more have seared his soul over 63 years.

Yet when he softly recounts his most recent torture, a liver transplant in June after a battle with hepatitis C, he punctuates it with a Southern-inflected half-chuckle that's endearing.

"It's the roughest thing I've ever been through," says the lead vocalist/organist of Rock and Roll Hall of Famers the Allman Brothers Band. "I've been in military school, through six divorces, heh-heh — this is worse than all that."

The decision to seek a transplant was made soon after he had been cajoled into the recording studio last January to make his first solo album in 14 years, Low Country Blues, out Tuesday. Allman's reluctance (he'd last been in a studio in 2003, with the Allman Brothers) had stemmed from the death in 2002 of legendary producer Tom Dowd, who had guided Allman to most of his greatest successes. "It hit me hard. When recording would raise its ugly head, I would roll over and play dead."

But in 2009, Allman's manager lured him to Memphis to meet with 10-time Grammy-winning producer T Bone Burnett.

"I swear to God I had never heard of him," Allman says. "Has it ever struck you that the East Coast (Allman lives in Georgia) and West Coast (Burnett is based in L.A.) are shamefully divided?"

The two clicked. Allman says he was taken with a Burnett project to replicate Sun Studios at his home ("that was the hippest thing I had ever heard") and with Burnett's admiration for Dowd.

Says Burnett: "The place where we could relate most profoundly was in the blues. I didn't know how good a blues singer he was. He hasn't lost a thing — it just gets better with age."

The producer envisioned an album of lesser-known blues and R&B covers from artists who had inspired Allman, and gave him hundreds to sort through. The deal was almost scotched when Burnett insisted on using musicians other than Allman's touring band. "I almost slammed the door on him," he says. "I'm so glad I didn't. But that's two clicks from being an insult, you know?"

Allman softened when he saw that Burnett had assembled top-flight session veterans, including guitarist Doyle Bramhall II and Dennis Crouch on upright bass. Burnett sweetened the deal by bringing in longtime Allman friend Dr. John (Mac Rebennack).

"This is special," Rebennack says. "Gregg had been through health problems. And Duane (Allman's beloved guitar-legend sibling, who was killed in a motorcycle accident in 1971) had asked me to look out for his little brother, like he knew something maybe would happen."

Many of the songs Allman chose mirror themes in his life, most notably a harrowing Sleepy John Estes tune about a man who is rescued from drowning and considers mending his ways. "Floating Bridge definitely points to my life," Allman says. "It hits one of your sympathetic strings."

Knowing he had a solid album in the can gave him strength the past six months to recover from the transplant of his cancerous liver. "It did, it really did," he says. "Let me tell you, they put me through some pain."

He likens it to kicking his addictions in the mid-'90s. "Not as time-consuming, but as rough. I just kept saying and praying, 'This, too, will pass.' "

By October, he was playing solo dates and a few guest spots, including duets with Neko Case on Midnight Rider during Burnett's Speaking Clock Revue, and he's preparing for the Allman Brothers Band's annual March residency at New York's Beacon Theater. He'll play some festivals with his solo band (including Bonnaroo and New Orleans Jazz Fest) this summer and fulfill a few commitments with the Brothers, now in their 42nd year.

Though he wonders "how long the band will last," given the members' various side projects, he hopes for another studio album. "You've got to take care of the Brothers."

The Jets’ ability to overcome adversity has been a central theme this season. Recovering from their 45-3 loss to the Patriots and going on to beat the Steelers in Pittsburgh two weeks later is one example. Tuning out issues related to off-the-field shenanigans – some self-inflicted – has been another.
The Jets’ ability to live, learn and move on has not been limited to negative events. Their place in the N.F.L.’s final 8 might not have been possible without a victory – the 28-14 win over the Patriots on Sept. 19 – that has been given little notice in the last month.
Simply put, the victory changed the Jets’ fortunes. They were 0-1 after losing their season opener to Baltimore, 10-9, at home, and the natives were already getting restless. Was the offense ever going to score a touchdown? Were the Jets more like a 5-11 team instead of the one Rex Ryan said was going to the Super Bowl? Was Mark Sanchez a bust? Did Brian Schottenheimer deserve to be fired?
New England had just torched Cincinnati, 38-24, in its season opener. And if Tom Brady and the Patriots could not be reined in, the Jets were going to fall to 0-2, and they still had a challenging early schedule ahead.
Let’s go down the list of highlights:
1) With the pressure on, Mark Sanchez (21 of 30, 220 yards, 3 TDs) played his best game of the season. His 3 TD passes equaled his season high. His completion percentage (70.0) and his passer rating (124.3) were his best marks of the season. And Sanchez was at his best in the second half, when he threw 2 of his touchdown passes and the Jets controlled the ball for more than 20 minutes (20:02).
2) The Jets’ defense played the second half without the injured Darrelle Revis (hamstring), but it didn’t matter. The Patriots were kept off the scoreboard, the only time this season they were scoreless in a half.
3) The Patriots were held to their lowest point total of the season (the Browns also held the Patriots to 14 points, on Nov. 7).
4) The defense forced three turnovers in the second half (2 INTs and a fumble recovery). The two interceptions were half of Brady’s season total of 4.
5) The defense weathered the Patriots’ early storm. New England rolled up 211 yards in the first half, including touchdown drives of 80 and 75 yards. But the Patriots managed only 90 total yards in the second half.
6) Dustin Keller (7 receptions for 115 yards, TD) had one of his most active games of the season. His 115-yard total was a season high, and his seven catches equaled his season high.
The victory was the Jets’ fourth-most decisive of the season, bettered only by their two wins over Buffalo and a 26-10 victory over Cincinnati. The victory also sent the Jets off on a stretch in which they won 9 of their next 10.
It’s perfectly understandable that the Jets’ 28-14 victory hasn’t gotten a lot of attention this week. The reason can be summed up in three numbers: 45-3. But victories all count the same. As Bill Belichick said earlier this week, it is probably fitting for this season series to be settled by a best-of-3.

England prevails over Australia by 1 wicket at Adelaide

Chris Woakes hit the winning run from the final ball to give England a one-wicket win over Australia in the first Twenty20 cricket international at the Adelaide Oval on Wednesday.

Woakes scored 19 from 15 balls to guide the critical last stage of England's run chase as it replied with 158-9 to Australia's total of 157-4. The win gave England a 1-0 lead in the two-match series, the second of which is at Melbourne on Friday.

Australia allrounder Shane Watson almost single-handedly steered his side to victory, scoring 59 from 31 balls — the highest score of the match — and taking 4-15 to hamper England's chase.

Eoin Morgan topscored for England with 43 and Woakes showed composure beyond his years to steer his team home as it chased four runs from the last over.

England seemed headed for a comfortable win as it reached 50 inside five overs in front of 32,000 fans, and on a ground on which it achieved one of its three wins in the recent five-test Ashes series.

But Watson, already Australia's batting hero, almost turned the match when he struck with successive balls to remove the dangerman Morgan and Michael Yardy, prompting England's slump from 130-5 to 130-7 inside the 16th over.

Watson also dismissed Tim Bresnan, who hit 11 from 11 balls, to deny England another of the strokemakers who might have made the late stages of the run chase more comfortable.

England finally came to the last two overs needing 15 runs to win and with only two wickets in hand. Woakes and Graeme Swann combined to take 11 runs from the 19th over, bowled by Brett Lee, and to leave England needing four from the last six balls with two wickets in hand.

The last over fell to Watson and he immediately ramped up the tension on both sides when he dismissed Swann for 6 with the first ball. The action left England's final pair at the crease, the redoubtable Woakes at the non-striker's end and the last man in, Ajmal Shahzad.

Shahzad struggled for three deliveries to work the single that gave Woakes the strike and the chance to decide the match. Unfazed by the drama around him, Woakes worked the penultimate ball for two to tie the scores then crashed the final ball through wide mid-on for the winning run.

Earlier, Watson made the largest contribution in Australia's bid to set England an unreachable target. He hit six fours and three sixes in his 31-ball innings of 59, taking 26 runs from a single over of Swann's offspin.

He put on 83 for the first wicket in 8.4 overs with David Warner, who made 30 from 28 balls with five fours. The openers seemed to have set up Australia for a formidable score but it failed to capitalize on that start.

Tight bowling by Yardy, Shahzad and Bresnan saw the home side fall well short of a defensible score.

Yardy dismissed both openers and finished with 2-28 while Bresnan removed David Hussey for 28.

Calif man arrested over threats to congressman


RIVERSIDE, Calif. — A California man was arrested Wednesday on a charge that he made threatening, obscene phone calls to the office of U.S. Rep. Jim McDermott last month, weeks before a gunman shot Rep. Gabrielle Giffords and others in Arizona.

An FBI complaint unsealed in federal court said Charles Turner Habermann, 32, of Palm Springs, called the Seattle Democrat's office late Dec. 9 and early Dec. 10 and left two messages, each about four minutes long, after seeing him on television.

He began each with his name and phone number, and went on to threaten to kill the congressman — as well as his friends and family — over his opposition to extending tax cuts for the wealthy, according to transcripts recited in the complaint.

Habermann faces one count of threatening a federal official, which carries up to 10 years in prison.

According to the transcript of one call to McDermott's office, Habermann said, "He thinks he can steal money from people and give it away to losers and get away with it." It continues, "I'll (expletive) hunt that guy down and I'll (expletive) get rid of him."

In the other call, Habermann allegedly said, "If he ever (expletive) around with my money, ever the (expletive) again, I'll (expletive) kill him, OK."

Habermann also left a threatening message on the voice mail of a congresswoman listed in the criminal complaint as "C.P.," and he threatened a California assemblyman, the U.S. attorney's office said.

Willy Ritch, a spokesman for Rep. Chellie Pingree of Maine, confirmed that she was the representative referred to in the complaint.

He said a threatening message had been left on her voicemail since the election, but the threat was actually directed at another member of Congress. He declined to comment further, citing the ongoing investigation.

The assemblyman is V. Manuel Perez, a Democrat who represents the Palm Springs area, said Perez spokeswoman Amy Wilson.

$300,000 bond
Habermann, who wore a maroon-striped shirt and bunched black jeans, made his initial appearance Wednesday afternoon in U.S. District Court in Riverside.

U.S. Magistrate Judge David Bristow set bond at $300,000 and placed him on home detention pending his next court date in Washington state on Jan. 25. Habermann could be released as early as Thursday.

Bristow ordered Habermann not to contact any of the people he allegedly threatened as well as their families and staff members, nor was he to reach out to any elected official. Habermann also will undergo drug and alcohol testing as well as a mental health evaluation.

Before his hearing, Habermann was animated and discussed the case with his attorney, federal public defender Joan Politeo.

"Anyone who knows me, knows I wouldn't hurt anyone," Habermann told Politeo.

Seattle FBI spokesman Fred Gutt said the complaint was already being drafted before Saturday's shooting in Tucson that killed six people.

The FBI said agents visited Habermann on Dec. 10, and he admitted leaving the messages and identified himself as the caller when he listened to a recording of the calls.

He said he'd been drinking when he made the calls but was not so drunk that he wouldn't have driven his car, the agents reported.

Seattle U.S. Attorney Jenny Durkan said in a news release that citizens have a right to debate government officials but not threaten them.

"Those actions are intended to silence debate, not further it," she said. "They instill fear not just in the immediate victims, but in many who might hold the same views or take the same course."

Habermann also left two voicemail messages for Perez on March 23, one of which threatened to kill the California assemblyman, according to court documents.

He seemed 'agitated, paranoid'
A week earlier, Habermann met with one of Perez's staffers and began ranting about the federal health care bill and how he didn't want to support immigrants and Latinos, records show.

"He seemed agitated, paranoid and couldn't keep still," said CHP Officer John Quintero, who referred to a report about the incident.

Habermann was escorted out of Perez's office, and the case, along with the threatening voicemails, was referred to the California Highway Patrol's Dignitary Protection Section, Quintero said. Habermann was never arrested.

"In this line of work we often interact with agitated people for a range of reasons," Wilson said.

"Through the course of dialogue and providing service to them, you can assess how conversation is going to go. This situation escalated where we felt we needed to inform law enforcement," he added.

Sen. Patty Murray, D-Wash., has also faced threats recently.

One man was sentenced to a year in prison for making threatening phone calls, and another is scheduled to face trial next month on charges he waved a meat cleaver toward her and threatened to kill her during an appearance in Spokane.

New Fears Over Sarah Palin's Stalker


A man who's been legally ordered to stay away from Sarah Palin is causing a new wave of concern in Alaska -- after federal agents learned he plans to visit Sarah's home state in the very near future.

TMZ has learned ... 19-year-old Shawn Christy has told family members he plans to travel to Wasilla in the hopes of removing the restraining order issued against him last year after Sarah and her close friend Kristan Cole proved he sent them threatening emails and letters.

Now, Cole is launching a preemptive strike -- through the courts -- in the hopes of blocking Shawn from "dissolving" the restraining order.

Cole just filed new documents, obtained by TMZ, explaining how Shawn has continued to harass her and her family in the past few months ... and keeping the restraining order in place is essential to their safety.

Law enforcement sources tell us Shawn -- who lives in Pennsylvania -- has not been spotted in Alaska yet ... but he's already filed a motion to remove the protective order.
